Intentional killing (manslaughter (or murder in common speech)), which can receive sentences after ç237 with jail up till lifetime. This definition has the intention of killing included.
Unintentional killing (or unintended manslaughter), which can receive sentences after ç241 with a sentence limit of up till 4 months of prison (yet up till 8 years under acute circumstances). This definition withholds only the lack attention and common awakedness.

Well, in America there is what they call 1st, 2nd and 3rd degree murders.

1st being premeditated, or planned ahead of time
2nd is killing the peson/persons on impulse
and 3rd being accidental with no prior intention of killing.
________
Could you, Rimdogg, perhaps provide more information on this story? Or perhaps where I can find more info?

I believe it may actually be accidental death reather than murder. (For example, a guy driving sees a red light, but can't stop in time, hits and kills a pedestrian.) I can't really comment more about this without more details.

Murder cannot be accidental, it can LOOK like an accident, but murder can't be an accident. If someone died by your doing, it would be considered a fatal mistake or something, but not murder.

Accidental manslaughter should not be punished. There was a guy in our hometown who was driving in the winter. His car hit a patch of black ice, spun out of control, hit and killed someone.

Now why would he be punished for doing nothing wrong at all?

I had a friend that owned a convenience store in Dallas. It was in a really bad part of town, I used to go hang with him on the weekends while on visitation with my dad. One day, someone was coming in with a sawed-off shotgun. My friend pulled his handgun and got 10 shots off before the guy opened the door. It was out of total defense. He was never charged with the death of the guy with the shotgun. My friend is ruined by the guilt of killing that man even though it was his own life that he saved. Should he have been charged? I don't think so! If it's defense, it's OK!

Yeah that happens Shake.

There were two people who were robbing this Taxan's neighbor's house. The guy called the police but they said it will take 10 minutes. He just hanged up and shot both of them with his shotgun. Dead.
No charge, lol.

Zophia mentioned the most important part: Intention.

Did she? Or was it me first? lol XD

I looked through all of these pages and I am disappointed. Does anyone read the older pages anymore? You need witnesses to confirm that he did in fact murder, you need the evidence to prove he committed a murder, and with all of these, you also need a clear motive as to WHY he committed that murder. None of these were confirmed, so he was free. Easy as PB&J.
