I get the feeling that the response here will differ from other forums due to the demographics. I see a lot of jokes from most of you about how the age of people you'd be interested in would qualify as "minors" because most of you are minors yourself!
I think that loud and clear shows you my views, but essentially I think the cases in this article highlight the inadequacy of the legal system and the model it currently follows in the face of new technology and modes of communication as well as dynamics. I can only hope that it will catch up at some point.
One other thing: please, no jokes about the speaker's name!
I've chatted up women online, and there are *ahem* a few of which there have been some.. we'll say 'racy' photos exchanged.
here's some clause that states that the defendant must have taken sufficient action to ensure the age of the other party...as to what "reasonable measure" is, probably depends on the context. Online...would be difficult. I mean, like hell I'm telling you my age for a start >:3
I have a radical idea how about you just don't send pictures of your junk to people over the internet. That way you don't have to worry about the whole age thing. I mean do you really wanna hit some chick who's sending pictures of herself over the internet, that's a sure way to get std's. Also its not someone you can take her home to mom.

That made me giggle a little bit. Internet STD's.
As far as the subject goes, I always thought porn was defined as a sexual act of penetration. I don't see nude photographs as porn or nude photographs of minors as porn. The only time this becomes an issue is when an adult is purposely looking for images of nude minors. There are laws for a reason.
But I do think that there are many minors who are deceiving adults for the attention. In these cases, the minors should be punished, not the adults.

No, actually. We don't even live on the same continent. We're never going to get together; we both just thought it would be something fun.
Beyond that - it's not up to you who I decide to go to bed with, or introduce to my parents. It's not against the law for consenting adults to do this sort of thing, so - here's a radical idea for you: Why don't I do whatever the hell I want within the constraints of those laws, and you mind your own damn business.
Cumming also argued that such online activities are safer than traditional sexual games because there is no immediate physical contact and thus are less likely to lead to pregnancy or sexually transmitted diseases.
wait what? so spin the bottle now gets kids pregnant? That guy is full of crap...
Children should be prosecuted for that because it could be dangerous for them when the picture goes to the wrong person. I recall many times where I sent the wrong text message to the wrong person.
I think you're taking the man too literally, DDX. Though I wouldn't exactly wholeheartedly support every part of the argument he's quoted either, I must say...
Let me put it this way- "spin the bottle" fast-forwarding twenty years = "kids doing away with the games and just having sex instead".
And the thrust of the argument was that the punishment is disproportionate to the crime. Not just disproportionate, but also misdirected.

There are, believe it or not, internet sites for people who are a) curious b) brazen c) desperate enough to post their junk for all and sundry to gawk at. I'm obviously not allowed to link to any of them from here.

Ah, that makes a lot more sense, because at first I thought the guy meant that kissing gave you babies (mommy told me that!.... but seriously).

we'll talk over skype *wink* *wink*

Well I believe that they shouldn't necessarily have them on the sex offender list. Much like there is an age limit to regular pornography to protect children (ARE you over 18?: Yes No. Most of the time kids click yes anyway).
It's ridiculous they call that child porn. I mean if you are doing it of your own accord, not being forced to, then I don't see what's wrong with it. Unless of course you're giving them to 40 something year old guys who you don't even know. Which would just be stupid and I doubt most people would do that.
The reason they're making a big deal out of it though is because they don't know where those pictures will end up. Maybe a girl sends them to her boyfriend, then they break up and he posts them online and a whole bunch of old perverts get them.
It's not against the law for consenting adults to do this sort of thing
I got no problems if you know that person is an adult. Go for it, pictures away but if you don't then its like walkin' through a mine field, lady luck better be on your side. I wasn't tryin to attack you or whatever you do on the internet, i was just saying if you don't know if their an adult for sure then its not worth it.

plenty of children make child porn of their own accord it doesn't mean its a good idea

If everything we do that's not a good idea was illegal then there would be a ton more restrictions. Sure, it's not a good idea, but I don't think that it should be illegal. That would be like making jumping off your room illegal; sure it's not a good idea, but make it illegal?

I never said everything we do that's not a good idea should be illegal no one is saying that but just because a child consents doesn't mean it should be legal. Children/teenagers don't always know whats best for them even if they think they do.
