Massachusetts has declared that the smell of marijuana is not enough to order people out of their cars. Specifically when the police pull you over for speeding or other driving infringements.


That is wrong. I think that denying the police a way to catch criminals is just plain wrong.

The stateâs highest court, overturning precedent and denying police a crime-fighting tool, ruled yesterday that the odor of marijuana smoke is not enough for officers to order a person out of a parked car, now that possession of less than an ounce of marijuana is no longer a crime in Massachusetts.


So basically, the reason why they did it was because small amounts of marijuana was legal, and even small amounts can smell.

Still, I think someone in the state's highest court had been smoking when they made that decision.

Yeah, but smell enough that a cop can catch a whiff on the highway with all the other smells in the air? The only way to smell that potent, is to smoke in your car, and that should be very illegal.

Dude they need to do to marijuana what they did to alcohol and cigarettes, it would take care of the American debt fast. Legalize it and tax the crap outta if. Heck most people that smoke pot aren't gonna be able find their way to the car anyways, they will be safer than the drunks would be anyday!

LOL actually in all honesty i have never smoked weed before, but i have a lot of friends that do, I just think since its mostly harmless, and so many people are doing it and their gonna keep smoking it, the government might as well tax it and get us out of this debt, they would be completely out of it with a few short years lol

Massachusetts probably has a high rate of drug trafficking if you can believe it. It's so close to the Canadian border and, if you're aware how the world works, it's a good thing to know that many drugs are legal in Canada, including medicinal and (God forbid) "recreational" marijuana.

The way i see it if a person can drink whenever they want they they should be able to smoke pot whenever they want, alcohol has destroyed an infinite number of more lives and families than marijuana ever has, I would take a stoner over a drunk any day, at least you can mess with a stoner, a drunk is just going to pee all over the p[lace and act like a jerk to everyone, and then pass out on you couch and then they'll pee on the couch and then you'll have to get a new couch, at least the stoners only eat all you food lol

That would probably be because driving while high on marijuana most people drive slower and stay in their lane, meaning the marijuana is not why they were pulled over.

@Batgrumpy, you ssay you fear a drunk in a car more than someone high on marijuana.... Do you know how messed up and disoriented you are when you are higher than a balloon on weed? No, you said it yourself. I wouldn't trust myself to do much of anything besides sitting when that high. Legalizing marijuana is a completely different discussion, but I'll just say that taxing the sale of it would NOT cough up trillions of dollars in debt.

On topic, I think it is a bad idea, because if you can really smell marijuana smoke in your car over everything else (as said before), you PROBABLY have more than just an ounce on you

Precursor: I think weed is stupid and people are gonna die when they're 20 when they use it.

And the 'smelling' rule is stupid. They shouldn't marginally legalize an illegal thing. It's like letting a stinkbug in your house and then spraying perfume on it -- why the hell would you do that.

I like the whole... legalize + tax the crap out of it idea. It would stop the incessant Mexican border issues over the cartels and all the money we AREN'T making. I don't care if it won't give us 14 Trillion dollars to balance our budget, I'd just rather not have it go towards mexican druglords. Even though they sound kind of cool...

Also, Drunk drivers scare the shii out of me. I'm sure I'd not like anyone high or drunk behind a wheel.. I just think it's weird that Mass. legalizes an ounce.

It doesn't matter if they are black, white, blue, green or purple. If you smell the very distinct smell of marijuana, that is grounds for a car search.

Well, considering that medical marijuana is legal is Massachusetts (I think), wouldn't that make sense? I'd rather pull over a happy idiot that an angry stupid incoherent idiot.

Ehh... I'm not too crazy about the whole Medical marijuana thing. I see how I helps a terminally ill suffering, dying person cope and deal with the pain but now a doctor can give you weed legally so i don't really know what to think about this.

Let's just legalize it. There's no need to make it incredibly expensive by taxing it.

Sales tax is enough, sin tax is bull****. Morality should be governed by the people, not the government. Taxation does not discourage people from using a substance, and no substance should be marked as "good" or "bad" by the government. Keep weed cheap, keep it competitive, keep people happy.

NoName, honestly, you miss the point, taxing it would help turn the budgets solvent.

And I beg to differ, with sales tax on cigs oh so very high now, people are cutting down and quitting.


We should tax video games instead. It will encourage people to go outside. We should also tax the internet as well.
