First lets look at the question...Are guns bad..No for hundreds of years guns have been used for hunting and protection...Second..Lets look at the people who own them..99% of all guns owned are in safe hands..Its that1% that is not regulated[registered]that are a danger to society. Illegally owned and ,unfortuneatly used, are the only bad guns.

You answer your own question rather than Elitemagical's. However, even if he shoots you first, his act won't be called self-defense due to the fact that he's in your house. But if you think of it logically, he's defending himself from you and your pistol.
So, in theory, Elitemagical is right, your theory has a severe flaw.
