It is a federal law that you do not burn a flag unless it touches the ground, but you have to fold it somehow.

Sorry for double post, but for something to be unconstitutional, it actually has to say it in the constitution.

If the government didn't care, then why would it matter if the flag burning was constitutional or not?

I said they "wouldn't be too happy about it". This could be them indirectly being unhappy about the flag burning or directly. Their decision to get this guy might be because it had some negative effect on the people (which is the cause of their unhappy feeling).

yes, but they do it ceremonially, cuttin the field and stripes and burning each part seprately, thus it is no longer considered a flag.

Burning the flag should be punished because your nation's flag represents everything about your country. If it is disrespected, then it is a crime.
