Yes. That is the point of America. Not to imprison and torture innocents so we can get more bad guys. We let a few criminals go so that we can protect the innocents. Without these ideals, we are no better then Japan.
Those terrorists are probably guilty of war crimes. They were fighting without uniforms and they placed military installations inside civilian facilities, just to name a few.
