I'm sitting here watching the news and all of a sudden the people start talking about children sexting each other... apparently it has some people freaking out. Its a big enough issue that some states are trying to make laws about it. Sexting is defined by them as not only being words... but sending images of themselves. Thus they call it distribution of child pornography and possession of child pornography.

They've talked about jail time, classes (akin to driving school kinda classes...but w/ sexting >_&gt , fining the parents, whether or not to give the kid a criminal record.... does anyone have any further insight into the situation? does anyone have anything that they would like to say that either agrees or disagrees w/ the other people's suggestions? do you have any suggestions? ...or do you care?

Personally, I see no reason why parents should be legally punished. More than likely, they had no idea their children were participating in this behavior.

Now for the children. It is within my belief that the sender of the sext should be charged with distribution of child pornography, and the reciever of the sext should be charged with viewing child pornography. Both persons should have those crimes added to their criminal record, and after two occurances of sexting, they should receive prison time.

Look at it from this point of view. The Reciever didn;t know what was on the text and didn't ask for a sext. So they had no idea that it was anything other than maybe just a normal immature teenager text. Now it is not the recievers fault that they got pornography.

Due to the fact that they committed criminal offenses.

Look at it from this point of view. The Reciever didn;t know what was on the text and didn't ask for a sext. So they had no idea that it was anything other than maybe just a normal immature teenager text. Now it is not the recievers fault that they got pornography.


Allow me to clarify. The reciever should only be charged if he requested/accepted the sext. Opening a sext without knowing shouldn't be a criminal offense. However, continuing to view it should be.

I think that the sender of the sext should be charged and no one else. It's not ur fault that u opn it cause u dunno what's it gonna be. Also u can't do prison time if ur under 14 so that would be illegal to send a child to jail.

However, continuing to view it should be.

so in ur point of veiw gawking is now a federal offense?

Why should it be illegal, especially if they're 16+? 16 is the age of consent for sex in most states, after all.

Me being a teenager, I don't think this really should be such a big deal. However, I know someone who had charges pressed against him for this and was suspended from school because he got caught with the pictures on his phone during school hours. I could understand taking action if it is in a school and all but in general no. Perhaps my opinion is a little biased but sending suggestive texts and pictures isn't really doing any major damage. If anything the phone companies want us to keep their checks up lol.

what he's saying is that if the person receives it w/o knowing what it is, views it, and then immediately deletes it then they should not be penalized... and that if they're not expecting it, receive it, view it, and then keep it stashed away somewhere then they should be held accountable for the crime of possession of illegal material. If you gawk and then redistribute to other people so they may gawk and delete then you should be prosecuted for distribution of illegal material. the problem therein lies in how youths are to be punished... i say remove picture messaging from the phones of the kids and they'll have a harder time doing it. I don't have picture messaging and I'm not dying b/c of it.

Exactly. It is illegal for a minor to view pornography. A minor is anyone under 18 (in America). A sext is a pornographic image texted to another person. See the connection?

Alright, if the child is 14 or older, he should be sent to prison. However, if the child is under 14 but at the age of puberty, the child should have the criminal offense added to his record.

If both are underage whats the big deal. If it was between a 15 year old and a 20 year old then that should be illegal yes but does it make sense to charge a "child" with child pornography?

I know as a fact that that'l be useless. We're kids, we got no jobs so we got lots and lots of time to figure out how to get around that if we had to. I once stored pictures on my graphing calculator and then bought one of those wires that connects em to send pics. And i kinda like pic messaging since you can send stuff through it that you wouldn't otherwise be able to like art.

Pornography laws are never enforced, and are often civil at best. I've never heard a story of a kid being charged with viewing porn -ever-.

The authorities have better things to do than go around arresting kids for federal offenses on moralistic grounds. Let them be kids. Child pornography laws were meant to protect children, so by sending both willing parties to prison you void the law entirely.

And this is why American law sucks.

So what do you want instead? Someone like Mr.Vlad to be inforcing the laws? Or are you saying that arerican laws are just crummy?
